PROPERTY DISPUTE BATTLE WON IN COURT OF APPEALS

Scott Cain successfully handled a multifaceted real estate dispute regarding interpretation of a real estate lease agreement. The Fort Worth Court of Appeals agreed with Cain in dismissing an appeal which had the effect of affirming a summary judgment that Cain had secured in the trial court.

SUPREME COURT RULING

Scott Cain handled an appeal that made its way to the Texas Supreme Court. The Supreme Court affirmed part of the appellate court's reversal of the trial court and ordered additional proceedings. The case stemmed from lengthy and complex litigation over real estate contracts.

APPELLATE COURT REVERSES TRIAL COURT'S SUMMARY JUDGMENT

Scott Cain was brought in to handle the appeal of a summary judgment order in a complex operator agreement case. The Fort Worth Court of Appeals reversed the trial court's grant of summary judgment. The case involved a complex operator agreement between EOG and a landowner. The dispute centered around several disputes that included whether several wells were productive when drilled and whether the lease agreement was extended beyond the primary term.

CAIN SWORN IN AS CLEBURNE MAYOR

Scott Cain was sworn in as the Mayor of Cleburne as Scott's family, friends and a standing room only and overflow room filled to capacity watched. Cain talked about Cleburne's history and its future. He also discussed his first project, dubbed "Undercover Mayor." His undercover mayor project can be viewed on the city of Cleburne facebook page and on you tube. His first act as Mayor was to take a turn in a dunking booth for a city-wide employee luncheon.

" We've gotten a great response to the flags and have also received great comments about them," said CABC President Deanna King. AN APPELLATE VICTORY

Cain & Associates attorney Scott Cain successfully argued the appeal of a jury trial in a will contest and real estate case. After a successful jury trial, the Waco Court of Appeals affirmed all portions of the jury verdict in the case styled, In Re Estate of Ward. The appeal dealt with both technical procedure as well as substantive probate and real estate issues. "We are obviously pleased and very happy for our client," said Scott Cain.

Scott Cain successfully argued before the Amarillo Court of Appeals the affirmation of a trial court ruling regarding a will contest.

ANOTHER APPELLATE VICTORY

Scott Cain successfully handled the appeal of a probate proceeding. The Amarillo Court of Appeals agreed with Cain and affirmed a probate court in allowing the admission of a will to clear title to real estate. The Contestant had complained that the will was not offered timely. At trial, the will was admitted because the delay in offering the will for probate was not the fault of the applicant who offered the will as soon as the will was discovered. The applicant first discovered his stepfather's will in his mother's safe deposit box after the mother had passed away. Cain argued that while the deceased mother failed to timely offer the will for probate, the failure should not be attributed to her son since he had no way of knowing about the will until he discovered it in the safe deposit box. The Court of Appeals agreed, with Cain and the trial court.

ANOTHER SUCCESSFUL JURY VERDICT

A Jury returned a favorable verdict following a trial over the validity of a will and a lost deed. Cain & Associates attorneys Scott Cain asserted that a will executed by the mother of the firm's client was the result of undue influence by the client's step-father. The jury agreed. "This was an emotional trial," said Cain, "but the jury listened to the facts and justice prevailed." The jury also found that the decedent had executed and attempted to deliver a deed for the family farm to the firm's client and awarded attorneys' fees to the client.

CAIN & ASSOCIATES SUPPORT COMMUNITY EVENT

On May 22, 2010, Cain & Associates partner Scott Cain organized a community wakeboard event. "The event, held last weekend at Lake Pat Cleburne, strives to involve area children in wakeboarding and other water activities in a safe environment," stated Cleburne Times Review reporter Matt Smith. The event, designed to provide teenagers with professional wakeboard coaching, included 312 participants. "We were pleased with the turnout and very pleased that a lot of area students had the opportunity to learn to wakeboard from world class professional wakeboarders," Cain said.

GROUND BREAKING ON NEW FACILITY

The Cleburne Chamber of Commerce held a ground breaking ceremony for the new facilities of Cain & Associates. The new office building will be located at 508 N. Ridgeway in Cleburne. Joining the Chamber of Commerce were several elected officials.

SUMMARY JUDGMENT AFFIRMED

Scott Cain successfully handled the appeal of a trial court's grant of summary judgment. Scott argued that the appellate court should affirm the grant of summary judgment, which the court did. The case involved a real estate transaction and whether there was a legal agreement to convey real estate.

CAIN & ASSOCIATES SPONSOR CASA 5K RACE

Cain & Associates was one of the sponsors for the first annual "Speak Up For Kids CASA 5K" race. Johnson County CASA (Court Appointed Special Advocates) serves children within the county by filling the gap that is often left in legal proceedings involving neglected and abused children. CASA volunteers often ensure the well being of children caught in the middle of CPS pending cases. Many times, the CASA volunteer may be the only consistent aspect of a child's life during the difficult period of a court case or investigation.

The race boasted more than 300 participants according to the Fort Worth Star Telegram. "Thank you to everyone who came out and supported" the race. Sponsors like Cain & Associates made the fundraiser a possibility. One of the race's winners, Tyler Bullard, donated his winnings back to CASA.

ATTORNEYS ADDRESS RETIRED SCHOOL TEACHERS

Scott Cain spoke to the Johnson County Retired School Employees Association regarding estate planning and probate issues. During the symposium, Cain discussed the importance of a well thought out estate plan and the two fielded questions from the teachers. Six of Scott Cain's grade and high school teachers were present. "I am so proud of the education these dedicated teachers provided me and my peers," Scott said, "It was a pleasure to help give something back to such an important group."

APPEAL DISMISSED

Neighbors of historic North Anglin Street in Cleburne petitioned to keep alcohol sales out of a laundry mat located in a residential neighborhood. "They expressed concerns about public drinking, traffic, parking and safety of children." When the county judge agreed with the neighbors and denied the permit, the store's owner appealed by filing suit with the district court and suing three of the neighbors. After Cain & Associates took on representation of the neighbors, the store owner dismissed the appeal.

ANOTHER SUCCESSFUL APPEAL

Scott Cain successfully defended a positive trial court award in the Houston Court of Appeals. In a dispute over mineral reservation language in a deed, Scott successfully defended a mineral owner who was sued over a deed that reserved the minerals. The trial court granted partial summary judgment, and the case went to a jury trial. During the process of selecting a jury, the plaintiff's attorney dropped the remaining claims and Scott secured an award of attorneys' fees for his client from the judge. Scott handled the appeal which ultimately affirmed the favorable trial judgment.

APPEALS COURT AFFIRMED TRIAL JUDGMENT

Scott Cain successfully defending a favorable trial judgment in the Waco court of appeals. During the trial, Cain represented land owners whom an adjacent dairy farm caused cattle waste to drain upon their property. During the appeal, Cain argued that the trial court was correct in issuing death penalty sanctions for failure to comply with discovery by the other side. The court of appeals agreed and affirmed the trial court ruling.

RESIDENTS PACK CITY HALL OVER PLAT ISSUE

"Cleburne attorney Scott Cain, representing several homeowners living near the planned development, said the plat did not meet the ordinance's requirements because it is vague and lacks specificity...'Higher density plus decreased property values equals certain disaster,' Cain said."

Scott Cain had successfully defeated the measure before the planning and zoning committee, thus requiring a super-majority to overturn the planning and zoning decision.

MILITARY GROUP HONORS FIRM

Cain and another attorney was awarded the rare Seven Seals Award for their support of the troops and military reservists. The award was in recognition of Cain's "work supporting area National Guardsmen and Reservists." "We appreciate the ability to do what we do. We wouldn't be able to in other countries, but because of the brave men and women who serve our country, we have the ability to go into a free court system. We're very humbled by this award, but, we're just doing our part," Scott Cain told a Times Review reporter.

APPELLATE COURT AFFIRMED JURY VERDICT

Scott Cain successfully handled the affirmation of a jury trial he won regarding an oil and gas operator agreement. The appellate court affirmed the jury in a complex case involving non-working interest owners and an operating agreement. The Operator settled claims from an unsuccessful suicide squeeze but failed to properly account for the settlement proceeds to the non-working interest owners. Scott handled the jury trial and the appeal.

CAIN HELPS DRIVE DONATIONS

As part of an Arlington tradition, Scott Cain helped collect donations for the Arlington Christmas Samaratans/Goodfellow Fund. "Decked out in a Santa hat, Scott Cain volunteered his time collecting donations." Jennifer W. Sanchez of the Fort Worth Star Telegram reported. Amidst the background of chilly winds and the rustle of leaves, Scott and others raised money for a local charity dedicated to help those less fortunate.

BUSINESSES SHOULD TAKE A PROACTIVE APPROACH

"Whether you are a large or small company, customer complaints are part of business. How you handle those complaints can determine what ever the complaint turns into a lawsuit." Scott Cain, writing as a guest columnist in the Fort Worth Business Press. In addressing customer complaints, Scott went on to state that businesses should be prepared to "act quickly," "contact a lawyer," not "rest on your laurels," and "forget the blame game." Scott said that quickly establishing a strategy can often overcome costly litigation when done correctly.
