Cain & Associates was one of the sponsors for the first annual "Speak Up For Kids CASA 5K" race. Johnson County CASA (Court Appointed Special Advocates) serves children within the county by filling the gap that is often left in legal proceedings involving neglected and abused children. CASA volunteers often ensure the well being of children caught in the middle of CPS pending cases. Many times, the CASA volunteer may be the only consistent aspect of a child's life during the difficult period of a court case or investigation.
The race boasted more than 300 participants according the the Fort Worth Star Telegram. "Thank you to everyone who came out and supported" the race. Sponsors like Cain & Associates made the fundraiser a possibility. One of the race's winners, Tyler Bullard, donated his winnings back to CASA.

| Water case appealed to Texas Supreme Court

Cain & Associates is preparing an appeal to the Texas Supreme Court over a case against the City of Keene. the appeal involves a technical application of governmental immunity. After Cain successfully argued a landowner's right to a jury trial over whether or not the City was required to complete its contractual payments for its acquisition of land, the appellate court held that governmental immunity from suit had not been waived.
"There's a split of opinion in appeals courts across Texas on whether the government's sovereign immunity is waived in cases like this," Scott Cain said to a Cleburne Times Review reporter, "It's also an issue of just fundamental fairness. A govermental entity, a city, shouldn't be able to enter an agreement to buy land over time, then not pay. Not paying what they bargained for is tantamount to a taking. They shouldn't be allowed to hide behind governmental immunity as a means of taking without paying."
The appeal has gained attention statewide, prompting the City of Houston to file an amicus curiae brief. Because of the importance to all of Texas and because of the split of opinions in the state's court of appeals, Cain hopes the Texas Supreme Court will review the case.

| Attorneys Address Retired School Teachers

| Scott Cain and Mark Hines spoke to the Johnson County Retired School Employees Association regarding estate planning and probate issues. During the symposium, Cain and Hines discussed the importance of a well thought out estate plan and the two fielded questions from the teachers. Six of Scott Cain's grade and high school teachers were present. "I am so proud of the education these dedicated teachers provided me and my peers," Scott said, "It was a pleasure to help give something back to such an important group."

| Appeal in limbo

| Neighbors of historic North Anglin Street in Cleburne petitioned to keep alcohol sales out of a laundry mat located in a residential neighborhood. "They expressed concerns about public drinking, traffic, parking and safety of children." When the county judge agreed with the neighbors and denied the permit, the store's owner appealed by filing suit with the district court and suing three of the neighbors. After Cain & Associates took on representation of the neighbors, the store owner dismissed the appeal.

| Another Successful Appeal

| Scott Cain successfully defended a positive trial court award in the Houston Court of Appeals. In a dispute over mineral reservation language in a deed, Scott successfully defended a mineral owner who was sued over a deed that reserved the minerals. The trial court granted partial summary judgment, and the case went to a jury trial. During the process of selecting a jury, the plaintiff's attorney dropped the remaining claims and Scott secured an award of attorneys' fees for his client from the judge. Scott handled the appeal which ultimately affirmed the favorable trial judgment.

| Water Case Reversed On Appeal

In a case involving a dispute over an agreement to furnish water in exchange for conveying land, the Court of Appeals reversed a trial court's grant of summary judgement. "Our position is that [the City of] Keene entered an agreement to buy land and pay for it with water and sewer services and are now reniging on the deal," said Scott Cain who represents the landowner. "The City has to keep its obligations like everbody else," Cain went on to say.
Scott Cain sucessfully secured a reversal of the trial court's grant of summary judgment. The case will soon be sent back to the trial court for a trial on the facts of the case.

| Cain helped raise money for the Johnson County Court Assisted Special Advocate (CASA) by driving race cars in the annual Courthouse Speedway Challenge at Texas Motor Speedway. Cain raised funds for CASA to help train volunteers that assist abused and neglected children involved with Child Protective Services. Each year, Cain helps raise funds many children’s charities and hospitals. “Children are our future, it is only right that we help preserve and protect their future,” Scott Cain said.

| Residents pack city hall over plat issue

"Cleburne attorney Scott Cain, representing several homeowners living near the planned development, said the plat did not meet the ordinance's requirements because it is vague and lacks specificity...'Higher density plus decreased property values equals certain disaster,' Cain said."
Scott Cain had successfully defeated the measure before the planning and zoning committee, thus requiring a super-majority to overturn the planning and zoning decision.

| City ordered to leave RV Park's water running

A judge issued a restraining order preventing the city of Keene from turning off water to 156 residents of Scott Cain's client. "This reall is a little city with a laundry mat, storage faclity and swimming pool. They can't go without water," Cain's client told the Cleburne Times Review.
In a real estate dispute regrding an agreement furnish water in exchange for land, Cain's client was charged for water believed to be covered by the agreement. "My client's first concern is that residents have water while this matter is being sored out," Cain said. The judge agreed and issued the temporary restraining order.

| Military group honors firm

| Cain and another attorney was awarded the rare Seven Seals Award for their support of the troops and military reservists. The award was in recognition of Cain’s “work supporting area National Guardsmen and Reservists.” “We appreciate the ability to do what we do. We wouldn’t be able to in other countries, but because of the brave men and women who serve our country, we have the ability to go into a free court system. We’re very humbled by this award, but, we’re just doing our part,” Scott Cain told a Times Review reporter.

| Jury Finds fraud in anti-trust lawsuit

Scott Cain successfully argued a Texas Antitrust lawsuit before a Johnson County, Texas jury. After approximately seven hours of deliberation, the jury returned a verdict in excess of $800,000.00. The case dealt with former partners of a telecommunications business and the former partners’ computer software provider. After the partnership split, the software provider continued to provide services to both former partners.
Cain argued that one partner and the computer software provider agreed to charge the other partner a higher price for the software services. Scott Cain told Shirley McKee, reporter for the Cleburne Eagle News, “If you don’t believe the democratic process works, just go to the courthouse and watch our jurors perform their duties.” The Cleburne Times-Review referred to the case as a major judgment. Cain’s client told Lowell Brown, reporter for the Cleburne Times-Review, “It’s been a long time coming, and it’s very gratifying to have 12 of my peers decide whether I was right or wrong. They decided I was right, and it feels good.”

| A whole lot of money

| Scott Cain handled a lawsuit for oil investors before a Johnson County, Texas jury. The result was just under one million dollars. Cain represented gas well investors who entrusted the gas well operator to pursue a prior lawsuit against a cement company. The cement company had cemented in the well during a process known as a suicide squeeze. The operator settled the underlying case for $600,000.00, but reported to the investors that the settlement was only $407,000.00. The jury awarded $192,000.00 along with attorneys fees and punitive damages. Scott Cain told Lowell Brown, reporter for the Cleburne Times-Review, “We had a great jury.”

| Cain Helps Drive Donations

| As part of an Arlington tradition, Scott Cain helped collect donations for the Arlington Christmas Samaratans/Goodfellow Fund. "Decked out in a Santa hat, Scott Cain volunteered his time collecting donations." Jennifer W. Sanchez of the Fort Worth Star Telegram reported. Amidst the background of chilly winds and the rustle of leaves, Scott and others raised money for a local charity dedicated to help those less fortunate.

Scott Cain, writing as a guest columist in the Fort Worth Business Press. In addressing customer complaints, Scott went on to state that businesses should be prepared to "act quickly," "contact a lawyer," not "rest on your laurels," and "forget the blame game." Scott said that quickly establishing a strategy can often overcome costly litigation when done correctly.
