Another Trial Victory- Sep 28, 2011
Scott Cain and Scott Riddle successfully argued a breach of contract case before a jury in Glen Rose, Texas. A waste management company had contracted with Cain & Associates' client to haul trash from a dump station to a landfill for a set amount over a period of time. The waste management company terminated the contract early citing various reasons. Cain presented evidence and argued that the company's reasons were pretext to support bringing the contract work in house. The jury agreed, and returned a verdict of $325,000.00. "The jury followed the evidence and watched the witnesses carefully," Cain said. "and in the end, they said that when you contract to do something, you have to honor your committments. If they other side decideds to appeal, we will be ready to fight to uphold the jury's decision." Source:

An appellate victory- Aug 26, 2011
Cain & Associates attorneys Scott Cain and Mark Hines successfully argued the appeal of a jury trial in a will contest and real estate case. After a successful jury trial, the Waco Court of Appeals affirmed all portions of the jury verdict in the case styled, In Re Estate of Ward. Another Appellate Victory- Jun 14, 2011
Scott Cain and Mark Hines successfully handled the appeal of a probate proceeding. The Amarillo Court of Appeals agreed with Cain and Hines and affirmed a probate court in allowing the admission of a will to clear title to real estate. The Contestant had complained that the will was not offered timely. At trial, the will was admitted because the delay in offering the will for probate was not the fault of the applicant who offered the will as soon as the will was discovered. The applicant first discovered his stepfather's will in his mother's safe deposit box after the mother had passed away. Cain and Hines argued that while the deceased mother failed to timely offer the will for probate, the failure should not be attributed to her son since he had no way of knowing about the will until he discovered it in the safe deposit box. Another Successful Jury Verdict- Oct 06, 2010
A Jury returned a favorable verdict following a trial over the validity of a will and a lost deed. Cain & Associates attorneys Scott Cain and Mark Hines aserted that a will executed by the mother of the firm's client was the result of undue influence by the client's step-father. The jury agreed. "This was an emotional trial," said Cain, "but the jury listened to the facts and justice prevailed." The jury also found that the decedent had executed and attempted to deliver a deed for the family farm to the firm's client and awarded attorneys' fees to the client. Source:

Another Large Verdict- Sep 13, 2010
Scott Cain secured a trial verdict of almost $2.5 million dollars on behalf of his client in a lawsuit involving claims of breach of fiduciary duty. The judgment included findings of breach of contract, breach of a partnership agreement, multiple breaches of fiduciary duty and an award of punitive damages. On May 22, 2010, Cain & Associates partner Scott Cain organized a community wakeboard event. "The event, held last weekend at Lake Pat Cleburne, strives to involve area children in wakeboarding and other water activities in a safe environment," stated Cleburne Times Review reporter Matt Smith. The event, designed to provide teenagers with professional wakeboard coaching, included 312 participants. "We were pleased with the turnout and very pleased that a lot of area students had the opportunity to learn to wakeboard from world class professional wakeboarders," Cain said. Cain & Associates Sponsor CASA 5K Race- Dec 09, 2009
Cain & Associates was one of the sponsors for the first annual "Speak Up For Kids CASA 5K" race. Johnson County CASA (Court Appointed Special Advocates) serves children within the county by filling the gap that is often left in legal proceedings involving neglected and abused children. CASA volunteers often ensure the well being of children caught in the middle of CPS pending cases. Many times, the CASA volunteer may be the only consistent aspect of a child's life during the difficult period of a court case or investigation.

The race boasted more than 300 participants according the the Fort Worth Star Telegram. "Thank you to everyone who came out and supported" the race. Sponsors like Cain & Associates made the fundraiser a possibility. One of the race's winners, Tyler Bullard, donated his winnings back to CASA.

Attorneys Address Retired School Teachers- Nov 17, 2009
Scott Cain and Mark Hines spoke to the Johnson County Retired School Employees Association regarding estate planning and probate issues. During the symposium, Cain and Hines discussed the importance of a well thought out estate plan and the two fielded questions from the teachers. Six of Scott Cain's grade and high school teachers were present. Appeal Dismissed- Nov 16, 2009
Neighbors of historic North Anglin Street in Cleburne petitioned to keep alcohol sales out of a laundry mat located in a residential neighborhood. "They expressed concerns about public drinking, traffic, parking and safety of children." When the county judge agreed with the neighbors and denied the permit, the store's owner appealed by filing suit with the district court and suing three of the neighbors. Another Successful Appeal- Oct 15, 2009
Scott Cain successfully defended a positive trial court award in the Houston Court of Appeals. In a dispute over mineral reservation language in a deed, Scott successfully defended a mineral owner who was sued over a deed that reserved the minerals. The trial court granted partial summary judgment, and the case went to a jury trial. During the process of selecting a jury, the plaintiff's attorney dropped the remaining claims and Scott secured an award of attorneys' fees for his client from the judge. Cain helped raise money for the Johnson County Court Assisted Special Advocate (CASA) by driving race cars in the annual Courthouse Speedway Challenge at Texas Motor Speedway. Cain raised funds for CASA to help train volunteers that assist abused and neglected children involved with Child Protective Services. "Cleburne attorney Scott Cain, representing several homeowners living near the planned development, said the plat did not meet the ordinance's requirements because it is vague and lacks specificity...'Higher density plus decreased property values equals certain disaster,' Cain said."

Military group honors firm - Sep 15, 2006

Jury Finds fraud in anti-trust lawsuit- May 01, 2003
Scott Cain successfully argued a Texas Antitrust lawsuit before a Johnson County, Texas jury. After approximately seven hours of deliberation, the jury returned a verdict in excess of $800,000.00. The case dealt with former partners of a telecommunications business and the former partners’ computer software provider. After the partnership split, the software provider continued to provide services to both former partners.

Cain argued that one partner and the computer software provider agreed to charge the other partner a higher price for the software services. Scott Cain told Shirley McKee, reporter for the Cleburne Eagle News, “If you don’t believe the democratic process works, just go to the courthouse and watch our jurors perform their duties.” The Cleburne Times-Review referred to the case as a major judgment. Cain’s client told Lowell Brown, reporter for the Cleburne Times-Review, “It’s been a long time coming, and it’s very gratifying to have 12 of my peers decide whether I was right or wrong. They decided I was right, and it feels good.”

A whole lot of money- Mar 24, 2003
Scott Cain handled a lawsuit for oil investors before a Johnson County, Texas jury. The result was just under one million dollars. Cain represented gas well investors who entrusted the gas well operator to pursue a prior lawsuit against a cement company. The cement company had cemented in the well during a process known as a suicide squeeze. The operator settled the underlying case for $600,000.00, but reported to the investors that the settlement was only $407,000.00. The jury awarded $192,000.00 along with attorneys fees and punitive damages. As part of an Arlington tradition, Scott Cain helped collect donations for the Arlington Christmas Samaratans/Goodfellow Fund. "Whether you are a large or small company, customer complaints are part of business. How you handle those compaints can determine whetehr the complaint turns into a lawsuit." Scott Cain, writing as a guest columist in the Fort Worth Business Press. In addressing customer complaints, Scott went on to state that businesses should be prepared to "act quickly," "contact a lawyer," not "rest on your laurels," and "forget the blame game."
