Founding Partner Scott Cain Elected to record Seventh term as Cleburne Mayor

On May 4, Scott Cain secured a record seventh term as Cleburne Mayor. He prevailed by winning 73 percent of the votes against his opponent. “I am honored that the voters remain confident in our administration and the direction of the community,” said Cain. “I believe Cleburne’s best days are just ahead.” Under Cain’s leadership, Cleburne has seen record growth as developers and new businesses come to the city. Cain has led the community in preparation for growth by improving the city’s infrastructure, creating a culture of quality improvement and customer service, and approaching governance through a pro-business approach. Since its founding in 1867, only two mayors have served for twelve years. With this victory, Cain will serve a record fourteen years.
Cain is the founder of Cain & Kiel Law. The law firm utilizes customer service and a pro-client approach to representation. From litigation matters and corporate transactional matters, and from estate planning, probate and real estate matters, the firm engages and empowers its clients with realistic options and strategies to achieve success. Cain’s service as mayor is a part of a long standing firm tradition of service to community.

Cain and Kiel’s founding partner, Scott Cain has served as Cleburne’s mayor since 2012. Recently, he filed to run for his seventh term which would make him the longest tenured mayor in Cleburne’s history. “It continues to be an honor to guide Cleburne through unprecedented growth,” said Cain. “I look forward to working with developers and new businesses coming to Cleburne and forging new partnerships to continue to grow the local economy while ensuring Cleburne is a great place to live, work and raise a family.” Cain continues to serve as the law firm’s managing partner and works primarily with real estate transactions, business agreements, and business litigation. He also is working to expand the firm’s title insurance work with Providence Title.

Leah received her juris doctorate from Texas A&M University School of Law earlier this year and previously clerked for the law firm. “We are excited to add Leah to our staff of attorneys,” said managing partner Scott Cain. Brent Kiel has been named a partner and the firm’s name changed to Cain & Kiel Law. “Brent has worked hard for our clients,” Scott Cain said, “and I am thrilled that he will continue to be a vital part of our team for many years to come.” Kiel continues to focus on probate and estate planning while also handling litigation and real estate matters. Managing Partner Scott Cain announced that he will seek a fifth term as Cleburne's Mayor. During his past four terms, he has led Cleburne through economic growth by balancing budgets, reducing the tax rate, and increasing the city's transparency. During Cain's tenure, he has led the community through recovery following the largest natural disaster in city history, bringing professional baseball back to Cleburne, and creating a pro-business environment that increased housing starts from under 15 starts per year to over 230 new starts in 2019. Cain believes that it is important to give back to the community and in addition to his service as Mayor, the other attorneys and staff also serve in various capacities.

Scott Cain continues to teach Business law at Southwestern Adventist University as an adjunct professor. Cain utilizes a practical approach to supplement his classroom instruction by having his class apply what they are learning in the classroom through creating a business entity, negotiating and drafting a contract and resolving business disputes. “My hope is to prepare the next generation of business leaders by investing in and engaging them in learning about the laws that impact business and encouraging them to continually learn more about business leadership,” said Cain. Most people know Scott Cain as Cleburne's mayor, but his law firm clients know him as a strong litigation and trial lawyer. Cain was recently recognized as the 2018 United States Civil Litigation and Trial Law Lawyer of the Year by Lawyer Monthly. Lawyer Monthly, an international professional publication with a large circulation, requested nominations for various awards and among the 20,000 nominations received in 2018 were several for Cain. Lawyer Monthly utilized several criteria for vetting its nominations, including number of third party nominations, legal expertise and innovation, peer recognition and personal achievement. Cain was recently notified that he was the publication's 2018 United States Civil Litigation and Trial Law Lawyer of the Year.
“I was surprised when I received the notification,” Cain said. “At first I thought, this has to be a mistake.” After confirming the award was for real, Cain quickly brought up his law office staff of assistants and lawyers. “I am honored by the recognition,” said Cain, “but it's a team effort that includes our great staff and wonderful clients.” Cain's staff wasn't surprised. “Scott pours his heart into his cases,” said fellow attorney Zach Brown, “he communicates options to his clients and works hard to get results.”
In addition to civil litigation and trial matters, Cain's Cleburne office handles real estate, business transactions, and estate planning and probate matters. “It has been an honor and challenge to help many businesses navigate both straightforward and complex legal issues,” said Cain. The law firm recently expanded its services to real estate closings when it opened a title company, Trinity Abstract & Title. “We wanted to add closing and title services to our real estate practice to assist our clients,” Cain added. “We wanted to be there for folks whether they are dealing with real estate issues, business matters or estate planning and probate matters.”
In addition to Cain's 2018 Trial Lawyer recognition, his firm was also recognized as a recipient of the Texas Top10 Award for Estate Planning. “Helping our clients navigate the tough issues of winding up a loved one's affairs is rewarding,” said Brent Kiel, another attorney with Cain & Kiel Law. After a week long jury trial, Scott Cain led the Cain & Kiel Law litigation team to victory in a commercial real estate case involving the Hillsboro Outlet Mall. The case involved a complex dispute over a sales contract that included reservations of easements, cross-easements and land use restrictions. “I am grateful for the hard work of the jurors who waded through lots of documents and listened to business and lawyer witnesses,” said Cain. “America's jury system works and we are grateful to finally resolve this dispute in favor of our client.”

Cain & Kiel Law managing partner, Scott Cain, announced the addition of Trinity Abstract & Title Company to serve the firm's clients and the surrounding area. “We saw a need with our real estate practice to add another service to our clients,” said Cain, “and we discovered that adding the title company business would help us serve the community better. Trinity Abstract & Title has a large support staff with personal touches through Colleen Gann and Scott Cain, local escrow officers. “We have attorneys assigned to each closing so we can answer questions that come up during the closing process,” Cain said. “We also offer a lot of custom services like remote closings. Our goal is to make real estate closings easier for both residential closings and complex commercial transactions.”

Scott Cain successfully handled a multifaceted real estate dispute regarding interpretation of a real estate lease agreement. The Fort Worth Court of Appeals agreed with Cain in dismissing an appeal which had the effect of affirming a summary judgment that Cain had secured in the trial court.

Scott Cain handled an appeal that made its way to the Texas Supreme Court. The Supreme Court affirmed part of the appellate court's reversal of the trial court and ordered additional proceedings. The case stemmed from lengthy and complex litigation over real estate contracts.

APPELLATE COURT REVERSES TRIAL COURT'S SUMMARY JUDGMENT

Scott Cain was brought in to handle the appeal of a summary judgment order in a complex operator agreement case. The Fort Worth Court of Appeals reversed the trial court's grant of summary judgment. The case involved a complex operator agreement between EOG and a landowner. The dispute centered around several disputes that included whether several wells were productive when drilled and whether the lease agreement was extended beyond the primary term.

Scott Cain was sworn in as the Mayor of Cleburne as Scott's family, friends and a standing room only and overflow room filled to capacity watched. Cain talked about Cleburne's history and its future. He also discussed his first project, dubbed “Undercover Mayor.” His undercover mayor project can be viewed on the city of Cleburne facebook page and on you tube. His first act as Mayor was to take a turn in a dunking booth for a city-wide employee luncheon.

After a successful jury trial, the Waco Court of Appeals affirmed all portions of the jury verdict in the case styled, In Re Estate of Ward. The appeal dealt with both technical procedure as well as substantive probate and real estate issues. “We are obviously pleased and very happy for our client,” said Scott Cain.

Scott Cain successfully argued before the Amarillo Court of Appeals the affirmation of a trial court ruling regarding a will contest.
ANOTHER APPELLATE VICTORY

Scott Cain successfully handled the appeal of a probate proceeding. The Amarillo Court of Appeals agreed with Cain and affirmed a probate court in allowing the admission of a will to clear title to real estate. The Contestant had complained that the will was not offered timely. At trial, the will was admitted because the delay in offering the will for probate was not the fault of the applicant who offered the will as soon as the will was discovered. The applicant first discovered his stepfather's will in his mother's safe deposit box after the mother had passed away. Cain argued that while the deceased mother failed to timely offer the will for probate, the failure should not be attributed to her son since he had no way of knowing about the will until he discovered it in the safe deposit box. The Court of Appeals agreed, with Cain and the trial court.

ANOTHER SUCCESSFUL JURY VERDICT

A Jury returned a favorable verdict following a trial over the validity of a will and a lost deed. Cain & Kiel Law attorneys Scott Cain asserted that a will executed by the mother of the firm's client was the result of undue influence by the client's step-father. The jury agreed. “This was an emotional trial,” said Cain, “but the jury listened to the facts and justice prevailed.” The jury also found that the decedent had executed and attempted to deliver a deed for the family farm to the firm's client and awarded attorneys' fees to the client.

On May 22, 2010, Cain & Kiel Law partner Scott Cain organized a community wakeboard event. “The event, held last weekend at Lake Pat Cleburne, strives to involve area children in wakeboarding and other water activities in a safe environment,” stated Cleburne Times Review reporter Matt Smith. The event, designed to provide teenagers with professional wakeboard coaching, included 312 participants. “We were pleased with the turnout and very pleased that a lot of area students had the opportunity to learn to wakeboard from world class professional wakeboarders,” Cain said.

Scott Cain successfully handled the appeal of a trial court's grant of summary judgment. Scott argued that the appellate court should affirm the grant of summary judgment, which the court did. The case involved a real estate transaction and whether there was a legal agreement to convey real estate.

Cain & Kiel Law was one of the sponsors for the first annual “Speak Up For Kids CASA 5K” race. Johnson County CASA (Court Appointed Special Advocates) serves children within the county by filling the gap that is often left in legal proceedings involving neglected and abused children. CASA volunteers often ensure the well being of children caught in the middle of CPS pending cases. Many times, the CASA volunteer may be the only consistent aspect of a child's life during the difficult period of a court case or investigation.
The race boasted more than 300 participants according to the Fort Worth Star Telegram. “Thank you to everyone who came out and supported” the race. Sponsors like Cain & Kiel Law made the fundraiser a possibility. One of the race's winners, Tyler Bullard, donated his winnings back to CASA.

ATTORNEYS ADDRESS RETIRED SCHOOL TEACHERS

Scott Cain spoke to the Johnson County Retired School Employees Association regarding estate planning and probate issues. During the symposium, Cain discussed the importance of a well thought out estate plan and the two fielded questions from the teachers. Six of Scott Cain's grade and high school teachers were present. “I am so proud of the education these dedicated teachers provided me and my peers,” Scott said, “It was a pleasure to help give something back to such an important group.”

APPEAL DISMISSED

Neighbors of historic North Anglin Street in Cleburne petitioned to keep alcohol sales out of a laundry mat located in a residential neighborhood. “They expressed concerns about public drinking, traffic, parking and safety of children.” When the county judge agreed with the neighbors and denied the permit, the store's owner appealed by filing suit with the district court and suing three of the neighbors. After Cain & Kiel Law took on representation of the neighbors, the store owner dismissed the appeal.

ANOTHER SUCCESSFUL APPEAL

Scott Cain successfully defended a positive trial court award in the Houston Court of Appeals. In a dispute over mineral reservation language in a deed, Scott successfully defended a mineral owner who was sued over a deed that reserved the minerals. The trial court granted partial summary judgment, and the case went to a jury trial. During the process of selecting a jury, the plaintiff's attorney dropped the remaining claims and Scott secured an award of attorneys' fees for his client from the judge. Scott handled the appeal which ultimately affirmed the favorable trial judgment.

APPEALS COURT AFFIRMED TRIAL JUDGMENT
August 21, 2007
Scott Cain successfully defending a favorable trial judgment in the Waco court of appeals. During the trial, Cain represented land owners whom an adjacent dairy farm caused cattle waste to drain upon their property. During the appeal, Cain argued that the trial court was correct in issuing death penalty sanctions for failure to comply with discovery by the other side. The court of appeals agreed and affirmed the trial court ruling.

“Cleburne attorney Scott Cain, representing several homeowners living near the planned development, said the plat did not meet the ordinance's requirements because it is vague and lacks specificity…'Higher density plus decreased property values equals certain disaster,' Cain said.”
Scott Cain had successfully defeated the measure before the planning and zoning committee, thus requiring a super-majority to overturn the planning and zoning decision.

Cain and another attorney was awarded the rare Seven Seals Award for their support of the troops and military reservists. The award was in recognition of Cain's “work supporting area National Guardsmen and Reservists.” “We appreciate the ability to do what we do. We wouldn't be able to in other countries, but because of the brave men and women who serve our country, we have the ability to go into a free court system. We're very humbled by this award, but, we're just doing our part,” Scott Cain told a Times Review reporter.

The appellate court affirmed the jury in a complex case involving non-working interest owners and an operating agreement. The Operator settled claims from an unsuccessful suicide squeeze but failed to properly account for the settlement proceeds to the non-working interest owners. Scott handled the jury trial and the appeal.

CAIN HELPS DRIVE DONATIONS

As part of an Arlington tradition, Scott Cain helped collect donations for the Arlington Christmas Samaratans/Goodfellow Fund. “Decked out in a Santa hat, Scott Cain volunteered his time collecting donations.” Jennifer W. Sanchez of the Fort Worth Star Telegram reported. Amidst the background of chilly winds and the rustle of leaves, Scott and others raised money for a local charity dedicated to help those less fortunate.

In addressing customer complaints, Scott went on to state that businesses should be prepared to “act quickly,” “contact a lawyer,” not “rest on your laurels,” and “forget the blame game.” Scott said that quickly establishing a strategy can often overcome costly litigation when done correctly.
